COBRA
The Consolidated Omnibus- Budget Reconciliation Act (COBRA) gives workers and their families who lose health benefits the right to choose to continue group health benefits provided by their group health plan for a limited time under a certain circumstances, such as voluntary or involuntary job loss, reduction in hours worked, death, divorce, and other life events. Qualified individuals may be required to pay the entire premiums up to 102 percent of the cost of the plan.
HIPAA
The Health Insurance Portability and Accountability Act (HIPAA) is a federal law that:
- Limits the ability of a new employee plan to exclude coverage for pre-existing conditions.
- Provides additional opportunities to enroll in a group health plan if you lose other coverage or experience certain life events.
- Prohibits discrimination against employees and their dependents based on any health factors they may have, including prior medical conditions, claims experience, and genetic information.
- Guarantees that certain individuals will have access to and can renew individual health insurance policies.
